Mirena IUD Complications
The Mirena IUD was introduced to the U.S. market in 2000. The small, t-shaped, flexible plastic device is a long-acting method of birth control that is implanted into a woman’s uterus. Once implanted, it releases levonorgestrel, a synthetic hormone, and can remain in the uterus for up to five years. In marketing the Mirena IUD, Bayer touted the device as the perfect method of birth control for “busy moms.”
Women who have filed Mirena lawsuits have accused Bayer of making misleading claims about the benefits of the IUD, and of understating its serious risks. Among other things, they allege that the company did not adequately warn that the Mirena IUD could spontaneously migrate from its position in the uterus long after a doctor had properly implanted the device in a woman’s body. They point out that the label for the Mirena IUD only states that migration can occur if the uterus is perforated while the IUD is being inserted. According to these lawsuits, the Mirena IUD can cause a number of serious injuries if it migrates, including:
- Uterine perforations
- Ectopic pregnancy
- Embedment of uterine wall
- Cervical perforations
- Perforation and damage to other organs if the Mirena IUD punctures the uterine wall.
Plaintiffs in Mirena IUD lawsuits aren’t alone in taking issue with Bayer’s marketing tactics. In 2009, the company received a warning letter from the FDA that criticized Bayer for a promotional campaign that downplayed the risk of serious Mirena complications, and overstated its benefits.
Mirena IUD Litigation
The federal multidistrict litigation for Mirena IUD lawsuits was established in the U.S. District Court, Southern District of New York in April 2013. When the consolidated proceeding was created, only about 40 Mirena lawsuits were initially transferred to the Southern District of New York. By February 2014, just over 400 claims had been filed in the proceeding, and hundreds of additional filings are expected.
A multidistrict litigation allows a large number of claims involving similar allegations of fact to proceed more efficiently. The federal Mirena lawsuits will be subject to coordinated pretrial proceedings, including discovery and motions practice. This should preserve the resources of the court and witnesses by eliminating duplicative discovery and inconsistent court rulings.
